Securing an Occupational Limited License

Several of the clients that we here at Schimizzi Law LLC have worked with in Greensburg following an arrest for driving while intoxicated are surprised to learn that such an offense results in the automatic suspension of one’s driving privileges. Yet a DUI conviction does not stop you from needing to get to work or other important places. Are limited to relying on public transportation (or the kindness of others)? Or are there options that will still let you drive in limited circumstances?

According to the Pennsylvania Department of Transportation, you may be allowed to apply for an Occupational Limited License after having had your regular driver’s license suspended following a DUI offense. Such a license will allow you to travel to places such as:

  •          To work
  •          To school
  •          To medical appointments

You should understand, however, that there may be certain aspects of your DUI case that could preclude you from qualifying for an OLL. If you were also cited for reckless driving or leaving the scene of an accident in conjunction with your DUI, you are not eligible for an OLL. Driving with a suspended license for reasons related to a DUI will also keep you from qualifying for a temporary license. You also cannot seek an OLL if you are participating in the state’s Accelerated Rehabilitative Disposition program.

To secure an OLL after a DUI conviction, you must first serve the mandatory 60-day license suspension that comes with a first-time offense (that suspension period increases to 12 months if this is your second conviction). Once that passes, you then must send a completed DL-15 form along with a $65 application fee to the DMV.
